—Order, Supreme Court, New York County (Barry Cozier, J.), entered December 1, 1999, which granted defendants’ motion to dismiss the complaint pursuant to CPLR 3211 (a) (1) and (7) to the extent of dismissing the first, fourth, fifth, sixth, and seventh causes of action, unanimously modified, on the law, to deny the motion as to the first cause, sounding in breach of fiduciary duty, and to reinstate that cause, and otherwise affirmed, without costs.
