Appeal from an order of the County Court of Rensselaer County (Jacon, J.), entered November 24, 2009, which classified defendant as a risk level three sex offender pursuant to the Sex Offender Registration Act.

In 2007, defendant pleaded guilty to rape in the third degree in Albany County Court and rape in the second degree in Rensselaer County Court and received concurrent sentences resulting in an aggregate prison term of 2 to 4 years.
