Plaintiff sued to recover damages for a failure by the alleged assignee of a leasehold estate to pay rents reserved in a certain lease. Judgment was given against plaintiff and in favor of Jas. H. Goodman & Co. Bank, but in favor of plaintiff as against Napa Valley Brewing Company. Two appeals were taken; one by plaintiff from that part of the judgment which was in favor of the bank and the other (based upon the judgment-roll alone) by the Napa Valley Brewing Company from that part of the judgment which is against it and in favor of plaintiff.
