OPINION
COOPER, Justice.
This is a workmen’s compensation case. The employee, Lonnie Eaton, was found to have a permanent partial disability as the result of a back injury sustained on Octo*11ber 9, 1972, while operating a tow motor for the defendant, Cleveland-Tennessee Enamel Company, and was awarded benefits accordingly. The employer appealed insisting there was no material evidence to support the chancellor’s finding that the accident and injury arose out of and in the course of plaintiff’s employment, or the finding that the plaintiff gave the required notice of injury.
