MEMORANDUM OPINION AND ORDER

THIS CASE comes before the court on petitioner Jim Floyd’s (“Floyd”) motion for return of property pursuant to Rule 41(e) of the Federal Rules of Criminal Procedure, filed September 18, 1987. The court has reviewed the petition and respondent’s answer. We have heard the testimony of the witnesses presented by the government at a hearing held November 23, 1987, and we have studied the parties’ briefs and the relevant case law.
