In an action to recover money paid by the plaintiff, a builder and developer, to the defendant Village of Searsdale, pursuant to an alleged illegal provision of the Village Code adopted pursuant to section 179-1 of the Village Law, and to declare such provision null and void, the .plaintiff appeals from an order of the Supreme Court, Westchester County, entered April 1, 1963, which denied its motion for summary judgment under rule 113 of the former Rules of Civil Practice, and which granted the defendants’ cross motion for summary judgment dismissing the complaint.
