Defendant appeals from his sentence to death resulting from the finding that in murders of the first degree he had killed two children, a brother and sister, one seven years old and the other nine.

The important facts elicited at the trial are these: Defendant, a street car conductor about thirty-two years of age, reported to his place of employment in the early morning of May 27, 1925, but was not assigned to duty.
