Appeal from a judgment of the superior court for Thurs-ton county, Linn, J., entered August 1, 1907, upon the verdict of a jury rendered in favor of the plaintiff, in an action for damages for ejecting a passenger from a railway train.

The defendant owns and operates a line of railroad betiveen Centraba and South Bend, in this state, and is a common carrier of passengers and freight for hire. It is not, hoAveA'er, a common carrier of passengers by freight trains, and does not hold itself out as such. On the contrary, *628in order to take passage by freight, the intending passenger must first purchase a ticket and procure a permit from the proper agent of the company, and freight conductors are forbidden to receive or carry passengers without such permit.
