This matter came before the Court for a four-day bench trial on plaintiff Kevin Kelly’s claim that his employer, the United States Small Business Administration (“SBA”), discriminated against him on account of his race and retaliated against him for pursuing past claims of discrimination, in violation of Title VII of the Civil Rights Act of 1964 (“Title VII”), as amended, 42 U.S.C. §§ 2000e et seq.
