In this case, the plaintiff in error, Lillian R. Millingar, joined by her husband, D. 0. Millingar, recovered a judgment for rent against the defendant in error, Robert Poster. The Court of Civil Appeals reversed that judgment, and rendered judgment for Poster. The Millingars applied for a writ of error on the ground that the decision of the Court of Civil Appeals is in conflict with the decision of the Court of Civil Appeals for the Third District in the case of Williams v.
