Plaintiff agreed to purchase from defendants twenty contiguous lots in Philadelphia, constituting one tract, for the sum of $7,500, the properties to be conveyed by “good and marketable” title, on or before a date fixed, “clear of all liens and encumbrances, excepting existing restrictions and easements, if any.” Ten per cent of the purchase price was paid when the contract was executed, which sum, it was stipulated, should be returned with any outlay made for title insurance, in case the vendors should fail to perform.
