In an action to recover damages for personal injuries, the defendant appeals, as limited by its brief, from so much of an order of the Supreme Court, Kings County (Lewis, J.), dated November 8, 2013, as denied its motion for summary judgment dismissing the complaint on the ground that the plaintiff failed to serve a timely notice of claim, and granted that branch of the plaintiffs cross motion which was to deem the complaint to be a late notice of claim and to deem it to have been timely served nunc pro tunc.

Ordered that the order is reversed insofar as appealed from, on the law, with costs,…
