We transferred this case from the Appeals Court on our own motion to consider whether a decision of the retirement board of Quincy (board) that the plaintiff’s entitlement to a retirement allowance (pension) had been forfeited pursuant to G. L. c. 32, § 15 (4), amounted to an excessive fine in violation of the Eighth Amendment to the United States Constitution. Because we conclude that the amount of the plaintiff’s pension forfeiture is not excessive, we affirm so much of the District Court judge’s ruling as determined that the plaintiff did not meet his burden of establishing that the…
