The petitioner is owner in fee of two undivided sixth parts of the real estate described in the petition, deriving his title by a devise in the will of William Lovering, by which also one undivided half part of the common estate described is subject to the life interest of Anna Maria Carter, the wife of Joel Carter, deceased, with remainder to her child or children who may be living at the time of her death, and, in default of any such child, to the children of Sophia Bass living at the time of Mrs. Carter’s death; and, in default of any such, to Joel Carter and his heirs.
