This case originated when Contec Corporation filed suit to compel Remote Solution Co., Ltd. (“Remote Solution”) to arbitrate an indemnification dispute. Remote Solution argued that it could not be compelled to participate in arbitration because Contec Corporation was a non-signatory to the arbitration agreement Remote Solution had signed with Contec L.P. in 1999.
