This ease presents the question of whether the defendant MissoúriPacific Railroad violated Title VII of the Civil Rights Act of 1964, 42 U.S.C. A. § 2000e-2(a) (1970), 1 by entering in to and enforcing a collective bargaining agreement providing for retirement at age 65 for firemen on its DeQuincy Division, all of whom were black. The agreement was made with International Association of Railway Employees (IARE), the union representing the firemen on the DeQuincy Division.
