Appellant instituted this action in the Huntington Circuit Court to recover for merchandise sold and delivered to appellees under a written order. Appellees filed a plea in abatement, alleging that the contract for the goods was entered into in the city of Andrews, Indiana, to be performed in the city of Canton, Ohio; that the contract on the part of appellant, a nonresident corporation organized for profit, was entered into by and through its agent, and that no application had been made by appellant, for or in behalf of its agent, to the Secretary of State of the State of Indiana for the…
