Paramore, the plaintiff below, recovered a judgment against the railroad company, from which the latter appeals.
It appears from the record that the recovery was had upon either the second or third paragraph of the complaint. Demurrers to these paragraphs were overruled; and this ruling presents the first question in the case. The averments are substantially the same in each. We state the facts as they are presented by the third paragraph.
