Appeal by the People from an order of the Supreme Court, Kings County (D’Emic, J.), dated April 28, 2004, which granted the defendant’s motion to dismiss Kings County Indictment No. 6893/03 against her.
Ordered that the order is reversed, on the law, the motion is *573denied, the indictment is reinstated, and the matter is remitted to the Supreme Court, Kings County, for further proceedings consistent herewith.
