This is 'an appeal by defendant from a judgment rendered in an action brought by appellee to recover damages resulting from the alleged negligence of defendant, and the negligence of one of its employees, a co-employee of plaintiff. The right of action for the alleged negligence of the co-employee was based upon the provisions of the act found in the Session Laws of 1901, page 161. The evidence disclosed that plaintiff’s spinal column was injured, which resulted in the complete paralysis of all that portion of his body .below the injury.
