This action was brought by the defendant in error to recover commissions .on a sale of real estate made by *351the plaintiff in error to one Jacobs. Defendant in error is a real estate agent, and he claims that he was employed by the plaintiff in error to sell a certain farm for him; that, after he had produced a purchaser, the plaintiff in error took the matter out of his hands and completed the sale, at the price of $3,000.
