KAUS, P. J.

After a court trial, the defendant was found guilty of a violation of section 11530 of the Health and Safety Code. Proceedings were suspended and he was placed on probation for a period of three years. He appeals from the judgment and from an order denying a motion for a new trial. The latter appeal must be dismissed.

Defendant’s only point on appeal is that a marijuana cigarette, which was the basis of his conviction, was seized in violation of his Fourth Amendment rights.
