This is an appeal by the People from an order granting a motion to suppress the evidence under the provisions of section 1538.5 of the Penal Code.
In an information filed in Los Angeles on April 1, 1968, defendant was charged with possessing heroin for sale on March 14, 1968. It was further charged that defendant previously had been convicted of a felony (assault by means of force likely to produce great bodily injury) in 1958 in Los Angeles and had served a term therefor in the state prison.
