This was an action brought by John Scanlan, against the Chicago and Alton Railroad Company, to recover for a personal injury received while in the employ of the railroad company as a brick mason, in building a roundhouse in Chicago. While the plaintiff, with others, was working on the round-house, a scaffold upon which he was standing gave way and he was thrown to the ground, a distance of twenty-five feet, and injured.
The original declaration contained one count, in which it was averred that the scaffold broke and fell owing to its faulty and improper construction by the defendant.…
