Plaintiff sued the defendant for damages in the sum of $7,800 for the destruction of her residence, with contents, by fire alleged to have been occasioned by sparks from a locomotive on a logging railroad owned by defendant.

The petition alleges that in 1895 plaintiff granted, without conqpensation, to defendant, permission to construct and operate said road over her lands, and that the track was laid within 100 feet of her house; that, after the lapse of several years, it became apparent that the operation 'of said railroad so near her residence was dangerous, on account of the emission of…
