MEMORANDUM OPINION AND ORDER
HART, District Judge.
Plaintiff Perry Marshall alleges that he was falsely arrested and maliciously prosecuted by defendants Carl Walker and Robert Grace, Maywood police officers. Presently pending is defendants’ motion to dismiss.
On a motion to dismiss, a plaintiffs well-pleaded allegations of fact are taken as true and all reasonable inferences are drawn in the plaintiffs favor. Leatherman v.
