Plaintiff, Rollins Cablevue, Inc., (hereinafter “Rollins”) has filed a verified complaint, seeking declaratory and injunctive relief against Saienni Enterprises and Clayton Cable, Inc. Plaintiff seeks to enjoin defendants from constructing and operating a Satellite Master Antenna Television system (SMATV) which allegedly violates the Cable Communications Policy Act (hereinafter “Cable Act”), 47 U.S.C. § 521 et seq., and the Delaware Regulation of Cable Television Systems, 26 Del.C. § 601 et seq.
