Plaintiffs Richard and Mary Wilson and Douglas and Elizabeth Woodall originally filed these two lawsuits in the Circuit Court of Elmore County, Alabama, against defendant Waverlee Homes, Inc., on a variety of theories based in tort, and for breaches of implied and express warranties, including violation of the Magnuson-Moss Warranty-Trade Commission Improvement Act (Magnuson-Moss Act), 15 U.S.C.A. §§ 2301-2312.
