The critical issue in this appeal is whether the crime of attempted robbery exists under the New Jersey Code of Criminal Justice, N.J.S.A. 2C:1-1 to 104-9 (Code). A jury found defendant guilty of first-degree robbery. The Appellate Division vacated the robbery conviction, finding the State failed to establish either the use of force or the threat of immediate bodily injury, proof of which is an essential element of the crime of robbery.
