Johnston, J. :

Robert Hawthorn Burton was informed against, tried, and convicted of murder in the district court of Marion county. On a former trial he was convicted of murder in the first degree, but on appeal the judgment of conviction was set aside for errors committed, and a new trial was awarded. (The State v. Burton, 63 Kan. 602, 66 Pac. 633.) The principal facts of the homicide are related in the report of the former appeal, and a restatement of them here is not necessary.
