This is the second appeal in this case from a judgment in favor of appellees. As the opinion on the first appeal, which is reported in 77 S. W. Rep., 983, states the pleadings of the respective parties and the nature of the case, they need not be fully stated here.

It is sufficient to state that appellees sued appellant to recover on three separate demands: (1) For $146, balance claimed to be due under a contract of sale of April 3, 1901, of an irrigating pumping outfit erected on appellant’s plantation in Brazoria County, near Sandy Point.
