Appeal by the defendant, the Union Bailway Company of Hew York City, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Hew York on the 18th day of December, 1907, upon the verdict of a jury for $750, and also from an order entered in said clerk’s office on the 9th day of March, 1908, denying the defendant’s motion for a new trial made upon the minutes.

In the afternoon of October 5, 1905, at about half-past three o’clock, the plaintiff was driving in One Hundred and Seventy-ninth street near Webster avenue, in the city of Hew York. As *774he was crossing Webster avenue from the westerly to the easterly side of One Hundred and Seventy-ninth street he saw a car approaching from the north about 175 feet away.
