Defendant-appellant-cross-appellee Hemp-stead China Shop, Inc. (“HCS”) appeals from a judgment entered January 20, 1994 hr the United States District Court for the Eastern District of New York, Arthur D. Spatt, Judge. The district court awarded summary judgment in favor of the plaintiffs-appellees-cross-appellants, the Trustees of Local 1245 General Benefits Fund (the “Trustees”), who sought to compel HCS to make delinquent contributions to the Local 1245 General Benefits Fund (the “Benefits Fund”)1 pursuant to § 515 of the Employee Retirement Income Security Act…
