For a number of years defendant Yonkers Railroad Company had been operating street car lines to the extent of about twenty-eight miles over highways of defendant city of Yonkers under franchises granted to it by the city. In voluntary proceedings in the Supreme Court, Westchester county, for the dissolution of the railroad on the ground of insolvency, a temporary receiver was appointed January 17, 1908, and then, by order of May 5, 1909, the railroad company was declared insolvent, ordered dissolved, and a permanent receiver appointed to receive and liquidate the franchises and other property…
