OPINION
RUSSELL, Judge.
James Samuel Tillery has appealed his conviction for second degree murder. In the judgment below the appellant was sentenced to 45 years in the State penitentiary. For reasons hereinafter stated, that judgment is affirmed.
The appellant asserts that he was denied the right to a speedy trial. In support of this contention he invokes provisions of the Sixth Amendment to the United States Constitution; Article I, Section 9 of the Tennessee Constitution; and Tennessee Code Annotated Sections 40-2001 and 40-2102.
