This is a habeas corpus proceeding in -which plaintiff and appellant alleges that he was unlawfully l estrained of his liberty by defendant, who is sheriff of Linn county, under a warrant of commitment issued by one Ball, a justice of the peace in and for said county, in pursuance of a judgment of conviction for violation of what is familiarly known as the “Anti-Cigarette Law.”
