This is an appeal by the State of Michigan from the entry of a consent decree between the United States Environmental Protection Agency (“EPA”) and twelve defendants 1 pursuant to the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (“CERCLA”), as amended by the Superfund Amendments and Reauthorization Act of 1986 (“SARA”), 42 U.S.C. § 9601 et seq.
