J. I. Palmer died intestate on April 18, 1946, while domiciled in Graves County, Kentucky. Some of the property which he undertook to dispose of by his will was located in Kentucky and some in Tennessee. The question for decision is whether the devise in Item 3 of the will, whereby the testator undertook to dispose of his property in this State, is void as being in contravention of the rule against perpetuities.
