The first assignment of error is *45based on the premise that the trial court erred in rendering the first judgment on the defendant’s general demurrer because after such demurrer was filed, and before such judgment was rendered, the plaintiffs filed a material amendment to the petition. This amendment to the plaintiff’s petition set forth a copy of the note sued on as well as a copy of the assignment of Siler’s interest therein to the plaintiffs.
