HARGRAVE, Justice.

This cause appears here on a writ of certiorari to review the Court of Appeals determination that a death benefit claim was not barred by the statute of limitations and that an employer-employee relationship was established between George Yocham and decedent by the evidence in this cause.

The decedent, Thomas W. Hendricks, was electrocuted while operating a ditching device on August 13, 1981. The deceased’s widow, Sheila Hendricks, filed a Form 3A listing the decedent’s son, Bronc W. Hendricks, as a dependent and Methvin Oil Company as respondent. The cause was set for…
