The evidence on behalf of the State tends to show that on 2 March 1968 Tim Douglas Lee, a 21-year old member of United States Navy, Larry Booth, the deceased, and the defendant met at a filling station in Raleigh “where everybody hangs out.” The defendant was the owner of a 1967 Chevelle automobile. The three, who were all acquaintances of a year or more, rode around in the front seat of the defendant’s automobile.
