Appellee, Harlingen Mall Company, filed suit against Wright Way Construction Company, and Atlantic Insurance Company, Inc., 1 appellants, for breach of contract and breach of warranty. The Mall also sued Atlantic for breach of the duty of good faith and fair dealing. The basis for the contract and warranty claims was Wright Way’s use of improper paving methods.
