The defendant, Kevin Corleto, appeals from an. order of the Superior Court denying his motion to dismiss on double jeopardy grounds 1 a criminal information charging- him with breaking and entering a dwelling, in violation of G.L. 1956 § 11-8-2. Specifically, the defendant’s motion to dismiss was predicated on alleged prosecu-torial goading that resulted in the declaration of a mistrial.
