This matter is before the Court on Plaintiffs Motion for Partial Summary Judgment and Defendant’s motion entitled “Motion to Dismiss, for Judgment on the Pleadings, and for Summary Judgment.” Plaintiff, X-IT Products L.L.C. (“X-IT”) moves for partial summary judgment against Defendant Walter Kidde Portable Equipment (“Kidde”) on Counts I (Copyright Infringement), IV (Breach of Contract), and V (Misappropriation of Trade Secrets) of its eight-count Amended Complaint.
