The appellant Bolton and the appellee Clark were opposing candidates for the office of treasurer of Vigo county at the general election held November 6, 1900. The board of canvassers, after a comparison and examination of the papers entrusted to it, and a count and tabulation of the vote of the county, declared the appellee, as the person having the highest number of votes given for the office of county treasurer, duly elected to that • office, and certified this statement in the planner prescribed by the statute.
