KLINGEMAN, Justice.

This suit was filed by Luis Lopez against H. E. Barnum and Dr. Rene E. Solis, Sheriff of Starr County. The parties will be referred to as in the trial court. Plaintiff’s original petition alleges the statutory action of trespass to try title to 634.-41 acres of land in Starr County, Texas, therein described, and prays for judgment for title and possession, rents, costs, and general relief. By alternative plea, plaintiff asserted that the Sheriff had levied on such property and was attempting to sell the same under execution to satisfy a money judgment obtained by H. E.…
