Mandamus. Delator applied for mandamus to compel respondent to levy the State tax apportioned to the county of Menominee for the year 1891. The facts are stated in the opinions.

This is an application for mandamus to compel the board of supervisors of the county of Menominee to levy the State tax apportioned to that county for the year 1891. The law provides that,—

“On or before the first day of September in each year, the Auditor General shall make and record in his office a statement showing the taxes to be raised for State purposes that year, referring to the law on which each tax is based, and the total amount of such taxes. This State tax he shall apportion among the several counties in proportion to the valuation of the taxable property therein, as determined by…
