This suit was instituted in the district court of Wichita county, Tex., by the plaintiff, Catherine V. Nowling, the surviving widow of Martin A. Nowling, deceased, against the defendant, the People’s Ice Company, to recover exemplary damages only.

Plaintiff alleged:

That her husband, Martin A. Nowling, died intestate on January 24, 1927, leaving no father or mother surviving and only one child, a son, who had long since reached his majority, and who had transferred to plaintiff all of his rights in and to. the damages she sought to recover.
