Nora Wells, widow of Arthur Wells, brought suit as authorized by section 26, art. 16, of the Constitution, for herself and as guardian for the four minor children of herself and deceased husband, against Morton Salt Company, to recover exemplary damages for the death of the husband and father, alleged to have resulted from the gross negligence of defendant. At the time of death, deceased was an employee of defendant, a subscriber under the Workmen’s Compensation Law; his death was reported to the Industrial Accident Board,- also to the Texas Employers’ Insurance Association; plaintiffs made…
