Appeal from the chancery court of Quitman county. Hon. Joe May, Chancellor. Suit by Monroe Nickerson against Fithian Land Company and others. From a judgment for defendants, plaintiff appeals. The facts are fully stated in the opinion of the court.

The appellant, Monroe Nickerson, filed his hill in the chancery court praying for specific performance of an alleged contract of purchase of certain land from appellees. The writing upon which appellant sought specific performance is here set out:

“Received from Monroe Nickerson the sum of nine dollars to apply on purchase of land on the south side of the town of Darling, to he measured later and paid for at the rate of thirty dollars per acre.”
